GoCart privacy policy

GoCart is a service of GoCart LLC ("Company" or "we" or "our"). We recognize and respect the privacy of individuals whose personal information the Company collects, uses, and stores in the course of conducting business. We are committed to processing personal information in accordance with applicable privacy laws and regulations as described in this Privacy Notice. Nothing in this Privacy Notice shall be construed to purport to override applicable privacy laws and regulations.

This Privacy Notice explains to individuals who access or use The Company’s services, including those who interact with our websites, platforms, integrations with merchants, mobile sites, and applications ( Sites and Services) ("you" or "customer"), how The Company uses your personal information.

Personal information used by GoCart

The Company collects personal information from customers in order to carry out its business activities and provide services to our customers, our merchant customers and their end consumers. The Company may collect personal information from various sources, including:

  • information provided to us directly from you;
  • information provided to us by a participating online merchant;
  • information provided to us from your bank or a credit card processor;
  • information automatically collected from your browser and device when you use our Sites and Services, including by the use of cookies; and
  • information collected from third parties, including but not limited to: fraud monitoring service providers, commercial databases, or know your customer (KYC) service providers and regulators.

This personal information may include:

  • Contact information, including but not limited to: name (first, last, and business), telephone numbers, address (shipping address and billing address), email address, and any other contact information you provide;
  • Correspondence you send to us, either by phone, email, or otherwise, in connection with your use of our Sites and Services;
  • Information related to items you purchase, including but not limited to: location of the purchase, value, time, method, any feedback that is given in relation to such purchase, and data associated with the items you purchase including at the SKU level;
  • Financial and credit/debit card information, including but not limited to: payment account number (PAN) or account number, card expiration date, card verification code, card equivalent information, tokenized card information, bank and/or card issuer details, any other information necessary to process a transaction, billing address, and loyalty point balances; and
  • Technical information automatically collected from your device and browser, including but not limited to: the IP address used to connect your computer or device to the Internet, your device ID, login information (username/password), browser type and version, time zone setting, browser plug-in types and versions, browser language setting, device operating system platform, mobile carrier, and location or GPS/geo- location.
  • Information about your visit or whether you opened an email, including but not limited to: the full Uniform Resource Locators (URL) clickstream to, through and from the Company’s site (including date and time), products or services you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks and mouse-overs), and methods used to browse away from the site page;
  • Information provided to us from your bank, including but not limited to: payment card information, name (first, last, and business), date of birth, telephone numbers, address, and email address;
  • Social media posts on the Company social media sites or made publicly about the Company on social media; and
  • Financing information: The Company may provide you with an opportunity to finance a purchase through a third party financial services lender. If you elect to explore such an opportunity, The Company may provide your information to the third party financial services lender or you may be directed to the third party financial services lender’s website. In addition to any information the Company provides to the lender, the lender may collect information necessary to provide you with information about a financing offer approve and potentially to process any request for credit you make. All such information would be submitted to the third party financial services lender and subject to the privacy policy maintained by that third party financial services lender.

Purposes for Collection of Information

We may use your information to:

  • enable you to access the Sites and Services;
  • complete a transaction or fulfill a service;
  • allow you to track your purchase and view purchase history;
  • communicate with you about your purchases;
  • send you updates regarding the Sites and Services;
  • respond to requests for information and provide customer support;
  • obtain your feedback and improve our customer service;
  • advertise products you may be interested in;
  • send you information about promotions, products or services we believe may be of interest to you;
  • verify that the right person is using the right card or account;
  • meet the requirements of the card brands or account issuers;
  • make sure we are paid for what you buy;
  • help us recognize your browser as a previous visitor and to save and remember any preferences that may have been set while your browser was visiting the Sites and Services;
  • assist in measuring, researching, and improving the effectiveness of our online content;
  • improve our Sites and Services;
  • if applicable, update your credit card loyalty point balance based on purchases you make with loyalty points;
  • update information about your payment cards in the event you need to replace your payment card;
  • if applicable, provide information about you to a third party financial services lender in connection with your election to pursue an opportunity to finance a purchase through a third party financial services lender;
  • update information about your payment cards in the event you need to replace your payment card;
  • create additional levels of customer authentication when logging in;
  • protect the security or integrity of the Sites and Services and our business, such as by protecting against and preventing fraud and unauthorized transactions, managing risk exposure, and identifying potential hackers and other unauthorized users; and
  • protect you and other customers against criminal activities and risks.

GoCart’s sharing of personal information

The Company does not sell your personal information. The Company may make personal information available to:

  • other parts of the Company, or its affiliated companies;
  • third-party service providers, including information technology service providers (e.g. for cloud computing), risk, fraud, and compliance service providers (e.g. for transaction risk monitoring); and for business analytics (e.g. for data aggregation, visualisation and reporting);
  • our business partners, including payment processors, payment infrastructure providers, participating merchants, banks and other financial institutions;
  • our professional legal advisors (accountants, consultants, lawyers and tax advisors);
  • law enforcement, regulatory, prosecuting, tax or governmental authorities, courts or other tribunals or dispute resolution bodies;
  • prospective sellers or buyers as part of a sale or merger of our company, business or assets; and
  • any other third party to the extent the disclosure is required by a law which applies to us. As the Company is a global business, the above recipients may be based outside of the United States.

Use of cookies

Information is collected by cookies and other tracking technologies when you use our Sites and Services. Cookies are small files containing information that uniquely identifies your browser. They are stored by your browser or other application on your computer’s browser or hard drive. We use cookies to track your new and returning visits to our Site. This information may be used to enable social media connections, enable you to set preferences, and produce website activity reports, including the number of visitors our website receives and which pages are viewed. Retention

The Company will retain personal information only for as long as it is needed for the purposes for which we use it, in accordance with our retention policy. The Company is committed to the confidentiality and security of personal information. The Company’s systems and facilities in which personal information are processed are protected by secure network architectures that contain firewalls and intrusion detection devices.

Links to third party sites

Our Sites and Services may, from time to time, contain links to and from the websites or services of partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites or services may have their own privacy policies and we do not accept any responsibility or liability for these policies, nor do we endorse such websites or services. We advise that you check any relevant terms before you submit any personal information to these third parties.

Your California privacy rights

California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once per calendar year information about the customer information we shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information. We do not currently share the personal information of California residents with third parties for their own direct marketing purposes. However, if you have further questions about our privacy practices and compliance with California law, please contact us as explained below.

In addition, if you are a California resident, the California Consumer Privacy Act provides you with the following rights with respect to your personal information:

When you exercise these rights and submit a request to us, we will verify your identity by asking you to log in to your account if you have one with us. Or if you do not, we may ask for your email address or account number. The Company also may use a third party verification provider to verify your identity.

The fact that you have elected to exercise these rights will have no adverse effect on the quality of our services.

Children's privacy

The Company does not knowingly solicit or collect personally identifiable information from children under the age of thirteen (13) without verifiable parental consent. If the Company learns that a child under the age of thirteen (13) has submitted personally identifiable information online without parental consent, the Company will take all reasonable measures to delete such information from our databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). If you become aware of any personally identifiable information we have collected from children under thirteen (13), please contact us at support@gocartpay.com.

Minors under 18 years of age may have the personal information that they provide to us deleted by sending an email requesting deletion to support@gocartpay.com. Please note that, while we make reasonable efforts to comply with such requests, deletion of your personal information does not ensure complete and comprehensive removal of that data from all systems.

Changes to this Notice

As this Notice is updated or modified, the current version will be posted on the Company’s Privacy section of Privacy Policy.
